Cruize Paradise 2024 Queens' Marketplace Waiver

I, (“Participant”), in consideration for being permitted to participate in the Event specified below (“the Event”) at the property listed below (the “Premises”) to the fullest extent permitted by law do hereby release, waive and forever discharge and covenant not to sue the owner of the Premises, its parent companies, subsidiaries and affiliates, and any of their officers, directors, members, managers, employees, shareholders, assigns and agents, and ABP Waikoloa LLC (each a “Released Party”, collectively, “Released Parties”) from any and all claims, demands, causes of loss, including, but not limited to, liability for property damage or loss, or bodily, personal or mental injury, including death, arising out of, or occurring in connection with Participant’s entry onto the Premises or related to Participant’s participation in the Event (each a “Claim”).


I recognize and acknowledge that my participation in the Event is solely at my own choice and risk and I have carefully and fully considered any risks, including, without limitation, dangers posed by the willful or negligent conduct of myself and others. I understand that this Waiver and Release of Liability (this “Release”) is absolute as to any Claim which may arise as a result of my participation in the Event.


I agree to indemnify, defend and hold the Released Parties harmless from and against any and all loss, damage, claim, action, demand, cost and expense arising out of, relating to, or resulting from my entry onto the Premises, and/or from any act or omission on my part while on the Premises, regardless of whether such loss, damage, claim, action, demand, cost and expense is caused in part by a party indemnified hereunder.


I further agree to abide by the rules and regulations of the Premises and agree that the Event may be canceled at any time without prior notice or warning. I agree to immediately cease participation in the Event upon request. I also authorize any photos or videos taken during the event to be used in Center advertising including, but not limited to print, social internet sites and broadcast. I certify that I am at least eighteen years of age unless otherwise noted below.


I HAVE READ AND FULLY UNDERSTAND THE SIGNIFICANCE OF THIS DOCUMENT AND VOLUNTARILY AND FREELY AGREE TO THE TERMS AND CONDITIONS SET FORTH HEREIN.


If Participant has insurance covering Participant’s participation in the Event, then Participant agrees to name Alexander & Baldwin, LLC, Series R (Owner), A&B PROPERTIES HAWAII, LLC, SERIES R (Managing Agent), A & B Properties Hawaii, LLC (Property Manager) and ABP Waikoloa LLC as additional insureds under Participant’s policy.


Parent or guardians by signing below agree to the terms herein on behalf of any minors under the age of 18 in his/her custody at the Event.
